APPLICATION TO USE THE LOGO
For the 70th anniversary of D-Day Normandy

PREAMBLE: OBJECTIVE OF REGULATIONS GOVERNING Use OF LOGO

In June 2014 the commemorations of the 70th Anniversary of D-Day and the Battle of Normandy will take place.

The Normandy Tourist Board has looked to mark this historic event with a specially designed logo.

The chosen emblem conjures up the wings of a dove but also the V for victory. The colour blue was used for serenity. The war is now over and peace, remembrance, reconciliation, construction of Europe, the handing down of history are order of the day especially for younger generations.

To this end, the Normandy Tourist Board has registered a simple French group trademark « 70th ANNIVERSARY D-Day NORMANDY LAND OF LIBERTY » (referred to hereafter as the trademark) with l'Institut National de la Propriété Industrielle in the classes 8, 9, 13, 16, 28, 33, 34, 35, 39, 41 and 43.

The Normandy Tourist Board is the sole holder of the trademark and the rights which belong to its registration.

The trademark’s mission is to enable the Basse-Normandie Region to bring together all the local partners who would like to promote this anniversary.

The trademark can be used by all companies who agree to uphold the current regulations of use.

These regulations of use lay out in detail the conditions and use of the trademark as required by the Normandy Tourist Board.

ARTICLE 1: PROCEDURE FOR GRANTING USE OF THE LOGO

The use of the trademark is open to all persons and government, associative and private organisations who wish to be associated with the Anniversary of D-Day and the Battle of Normandy and who are authorised to use the trademark.

The potential users of the trademark (herewith referred to as «the users») fall into the category below:

Ambassadors

1.1 The Ambassadors

-Definition

The Ambassadors are individual or legal entities who wish to register their hospitality and attachment to Normandy and in so doing become associated with the events of the 70th Anniversary and the Battle of Normandy.

Access to the trademark

The trademark is freely available to all the ambassadors who wish to be associated with the 70th Anniversary.

The logo of the trademark can be downloaded on the professional website of the Normandy Tourist Board website, www.pro-normandie-tourisme.com, once the regulations of use have been read and agreed to.

The Ambassadors can use the trademark on their websites, in their brochures, their shop fronts and on their products.

1.2. Other Uses

Should individual or legal entities wish to apply to use the trademark other than as an Ambassador, they are requested to submit their request in writing to the Tourist Board.

ARTICLE 2: Conditions of use of the Trademark

2.1. Nature and Extent of use

All persons authorised/ entitled to can use the trademark as registered in relation to the products/ services outlined.

This use should comply strictly with the design specs in the appendix to the current regulations and which are available on the professional website of the Normandy Tourist Board website, www.pro-normandie-tourisme.com,

The trademark and the dimensions, colours and constituent parts cannot be changed in any way.

The trademark cannot be subjected to any deformation, transformation, alteration, addition, or removal of graphic or verbal elements, animation or any other process.

The trademark cannot undergo any printing of images or words over the orginal trademark.

The trademark cannot be the object of any usage likely to be immoral or which would incite public disorder.

The Logo of the trademark will only be available to download from the site of the Normandy Tourist Board, www.pro-normandie-tourisme.com, with the specific forms for different usages.

The authorisation to use the trademark is strictly personal and cannot be granted to a third party.

The users agree not to transfer the logo digitally to another user.

2.2. Users’ Commitments

The use of the trademark should be part of the following framework:

  • - the desire to be associated with the mobilisation, reputation and the success of the Anniversary
  • - the desire to participate in the transmission of the values inherent to this event
  • - hospitality

The users of the trademark agree to use the trademark and respect the moral values of peace, handing down of memory towards young people, and reconciliation which this trademark symbolises. The users will not use the trademark in any way which could be understood as an incitement to violence or disrespect for religious beliefs, groups and identities. The users will not use the trademark in a general way which could lead to or harm the image and reputation of Normandy and/or tarnish the image of the trademark.

The users will not use register the trademark or a sign similar to the trademark in their name or on behalf of a third party.

The users will also not reserve identical or similar domain names in national or generic extensions which have not been reserved.

The users agree to accept and respect the scope of the trademark and all checks by the Normandy Tourist Board, by one of its members or by one of its representatives.

The users agree to respect all of the conditions in the current regulations and annexe.

The users agree to respect the technical specifications of the trademark as laid out in Article 2.1 and reproduced in the annexe of the current regulations.

2.3. Duration

The authorisation to use the trademark will remain with the approved party as long as the user continues to satisfy the conditions laid out in the current regulations.

2.4. Payment

The trademark is freely available to authorised and entitled users.

ARTICLE 3: WIthdrawal OF authorisation and SANCTIONS

The Normandy Tourist Board reserves the right to take whatever action necessary by whatever means necessary should the agreements in Article 2.2 not be upheld or in the case of unmoral, unethical use against laws and regulations which apply internationally or in France.

Should the authorisation be withdrawn, the users agree to no longer use the trademark in whatever form and to remove the logo immediately from all their promotional material.

ARTICLE 4: Changes to the Regulations of Use

The Normandy Tourist Board reserves the right to change the conditions of use of the logo of the 70th anniversary of D-Day and the Battle of Normandy at any moment and without prior warning during the lifespan of the trademark.

Article 5: Responsibility of the Normandy Tourist Board

The Normandy Tourist Board will not be liable in any way for any negative consequences resulting from faulty products or services bearing the trademark.

The Normandy Tourist Board will not be liable in the event of force majeure or actions beyond its direct control.

ARTICLE 6: Guarantee

The Normandy Tourist Board gives no guarantee to the users other than that of the material existence of the trademark.

To this end the users accept the present regulations of use at their own risk and under their own responsibility.

ARTICLE 7 : Dispute Clause

All disputes which could result from the present regulations, namely from the interpretation thereof, its application and evolution, will be submitted to the Director of the Normandy Tourist Board.

Any disagreements between parties as to the interpretation and / or application of the present regulations, as well as any dispute linked to the validity of the trademark, in the absence of an amicable solution, will be brought before the relevant court in Evreux, France.
